ROYAL DECREE 8/2023 APPROVED

After an arduous session in the Congress of Deputies, Royal Decree 8/2023, which modifies, among others, Law 34/1998, of October 7, on the hydrocarbons sector, was finally approved yesterday.

The part that interests us most is the following:

 

Three. Section 1 of article 43 is worded as follows:

 

«1. Retail distributors of oil products shall be those natural or legal persons who carry out at least one of the following activities:

  1. a) The supply of fuels and fuel to vehicles in facilities enabled for this purpose.
  2. b) Supply to fixed installations for consumption in the installation itself.
  3. c) The supply of kerosene for aviation.
  4. d) The supply of fuel to vessels.
  5. e) Any other supply that is intended for the consumption of these products.

Under no circumstances is supply between retail distributors, or supply from retail distributors to wholesale operators, permitted
